Excel Parking and Vehicle Control Services charge: how to appeal

Short answer
Excel Parking and its sister company Vehicle Control Services belong to the International Parking Community, so a rejected appeal goes to the Independent Appeals Service (IAS), not POPLA. Appeal to the operator within 28 days, then to the IAS within 28 days of a rejection; unlike British Parking Association members they need not re-offer the discounted rate if your appeal fails. The points that win are inadequate no-stopping signage on airport approach roads, pay machine and pay-by-phone faults, and residents' lease rights.

Excel Parking Services and Vehicle Control Services are related companies based in Sheffield, operating retail parks, station car parks, airport approach roads and residential sites across the North and Midlands. Both are members of the International Parking Community rather than the British Parking Association, which changes the appeal route: rejected appeals go to the Independent Appeals Service, and the operator is not obliged to re-offer the discount after rejecting you.

- Stopping on airport approach roads and drop-off routes where the signs say no stopping. Whether the signage forms a contract at all, and whether a brief stop in traffic breaches it, has been argued repeatedly; photographs of the signs and the circumstances of the stop are essential.
- Pay-and-display faults and pay-by-phone errors at retail and station sites.
- Grace periods on short overstays.
- Residential permit schemes applied to residents with a right to park under their lease.
- Late or defective Notice to Keeper.
To hold the registered keeper liable rather than the driver, the operator must comply with Schedule 4 of the Protection of Freedoms Act 2012: a camera-issued Notice to Keeper must be delivered within 14 days of the parking event, and a windscreen ticket must be followed by a Notice to Keeper between 28 and 56 days later, with the prescribed wording. If it misses any of this, it can only pursue the driver, and you are never obliged to say who that was. Keeper liability does not apply in Scotland or Northern Ireland.
How to appeal a Excel Parking charge
- Appeal to Excel Parking within 28 days of the date on the notice, using the online appeal link or the postal address printed on it. Quote the reference and registration, state your ground, attach evidence, and do not name the driver unless you choose to.
- If rejected, appeal to the IAS within 28 days. Excel Parking is an International Parking Community member, so the rejection letter will give you an IAS reference. The IAS adjudication is free to you and decided on the documents.
- Only a court can make you pay. After that the operator may use a debt recovery agency and may issue a county court claim. Recovery letters carry no legal force, but a claim form does: respond to it or a default judgment will follow.
International Parking Community operators are not required to re-offer the discount after rejecting an appeal, so decide whether to appeal with that in mind.
If a court claim arrives
Both companies issue county court claims. Acknowledge the claim, file a defence on the grounds above, and keep your evidence. Claims are decided on the facts, and drivers with photographs of inadequate signage and a clear account of events regularly succeed.
Common questions
Is a Excel Parking parking charge a fine?
No. Excel Parking is a private company and cannot issue fines. The notice is a claim that you owe money for breaching the terms on the signs. It is only enforceable if a court agrees, which requires the operator to prove a contract was formed and that it followed the Protection of Freedoms Act to pursue the keeper.
Why is my appeal going to the IAS and not POPLA?
Because Excel and VCS belong to the International Parking Community, whose appeals service is the IAS. POPLA only handles British Parking Association members. The IAS process is decided on the documents and is free to you.
What happens if I ignore a Excel Parking charge?
You will receive reminder letters, then letters from a debt recovery firm adding fees, and Excel Parking may issue a county court claim. Ignoring the claim form leads to a default judgment and a County Court Judgment on your credit file. Appealing is a better course than ignoring; if the charge is defective, say so on the record.
